Mistrial Motion In Tornado Cash Case Is Unlikely

The testimony of the special agent of the IRS Stephan George regarding some of the stolen funds of Hanfeng Lin who had been put through the cash of the Tornado seemed quite credible to inhibit the defense from presenting a motion for a myster.

On Monday, the defense in the cash trial of the Tornado floated the idea of presenting a motion for the Mistrial after the special agent of the FBI Joel Decapua said he had found the funds stolen from the first witness in the event, Hanfeng Lin, at the cash mixing service of the Tornado.

However, after today’s testimony from the special agent of the ISS Stephen George, the second witness who the accusation asked for training in the asset track on public blockchains, the chances of the defense that present a motion for mystery seem to the maximum slim.

The special agent George told how the Lifo accounting principal (Last in, First Out) employed and used tools and analysis software including EtherScan.io (a block explorer for Ethereum), Chanalysis Reactor and TRM workshops to trace the stolen funds.

According to George’s data from the special agent, about 149,000 USDTs were sent by Mrs. Lin’s Crypto.com account through a series of wallets. About a third of this amount was therefore exchanged with $ 9.78 (for a value of about $ 47,000 at the time) before moving in cash of Tornado on November 15, 2021.

The special agent George recognized that, according to the initial dissemination of the accusation, he was not commissioned to track down these funds stolen from Crypto.com to Tornado Cash, but who had started to do it at the end of June or at the beginning of July of this year.

The defense was deepened in their cross examination of the George special agent, but seemed to fight to find a hole in its history or a remarkable flaw in its analytical process.

The special agent George admitted that his analysis may not have been perfect, but said that the result of his analysis using chain tracking tools and TRM laboratories have produced similar results independently.

Having said that, the defense has shared that it plans to finish the special agent of Examining George at the beginning of the test day tomorrow.

So, there is still some possibilities that find a way to discredit some of the data it has presented, but based on the cross exam today, it does not seem likely, which means that the defense will have no reason to present a motion for mystrial.
