Support The Blockchain Regulatory Certainty Act (BRCA) To Protect Noncustodial Services

With a lot of regulatory speeches focused on the Genius Act and the Clarity Act (the bill on the market structure) at this moment, it is important that Bitcoin enthusiasts also pay attention and support the Blockchain Regulatory Certity Act (BRCA) – HR 1747.

The law, which was reintroduced to Congress on May 21, 2025 by Rep. Tom Emmer (R-MN) and Rep. Ritchie Torres (D-NY), provides “Harbour safe from licenses and registration for some unstressed blockchains developers and blockchain blockchain service providers”.

It also establishes that no developer or blockchain supplier of a blockchain service must be treated as a money transmitter unless developers or suppliers behind the project do not have control over user funds.

This bill is relevant because the developers both for Samourai’s portfolio and for the cash of the Tornado are currently facing charges to manage the activities of money transmitters without license, despite the fact that the developers for any of these technologies have ever had control of user funds.

It is also important because, under the Biden administration, the United States Department of Justice (DOJ) has not simply classified privacy services as money transmitters, but also accessory services such as lightning knots, rollup sequencers and other bitcoin and blockchain technologies.

If the BRCA is not implemented in law, there is a risk that all Bitcoin and Crypto portfolios and other non -antenical services and technologies are made illegal and/or subject to Kyc/AML laws.

While Rep. Emmer and Rep. Torres who reintroduce this bill are a positive step, congress members need our help to make the BRCA a priority for this current congress.

If this act does not exceed, we will have to face significant obstacles regarding the downsizing of Bitcoin and other blockchains, as well as for privacy.
